Were You a Denver CPAP User Affected by the Philips Recall?
Philips Respironics recalled over 15 million CPAP, BiPAP, and ventilator devices in June 2021 due to degrading PE-PUR foam that released toxic particles and chemical gases into users' airways. If you used a recalled Philips CPAP device while living in or near Denver, you may be eligible for compensation through one or both of the following settlement tracks:
- Economic Loss Track ($445M): You owned a recalled device. No health problems required. Your device is now worthless — that's compensable.
- Personal Injury Track ($1.1B): You developed health conditions — cancer, respiratory damage, or other injuries — from breathing foam particles and chemical gases.
Filing Deadline for Denver Residents
As a resident of Denver, Colorado, your claims are governed by Colorado's product liability statute of limitations of 2 years. Colorado has a 2-year statute of limitations for product liability claims, with a discovery rule for latent injuries. A 3-year repose period may also apply from date of purchase.
The discovery rule is critical: Many $Denver CPAP users only connected their health problems to their recalled device after the June 2021 recall announcement — meaning their statute of limitations clock may have started then, not when health problems first appeared.
